BEPS Actions made the tax audit more mature, yet more aggressive.

The event consisted in a comprehensive programme of presentations and practice related Q&A session, with participation from representatives of Mazars Romania, Mazars Hungary and Mazars Germany. Special guest Mr. Gabriel Biris, Former Secretary of Ministry of Finance shared his experience on the Ministry's plan on BEPS local implementation.
The transfer pricing changes brought by the BEPS Action Plan focuses on a few key elements. The first one refers to the substance of the transaction and to the fact that the transfer pricing analysis will concentrate on the parties behavior in order to generate added value for the entire group and the second key element is control over risk. It is absolutely important for the Romanian taxpayers to take them into account and understand them when documenting their intra-group transactions.
Overall, the conference participants agreed that utilizing opportunities provided by transfer pricing can provide benefits as: a lower effective tax rate; relief for stranded losses; better cost control; and improved cash flow.
It is essential for the Romanian taxpayers to understand the key requirements in order to present them in the transfer pricing file and also to be able to successfully defend in front of the tax authorities the transfer prices applied with related parties.
The conference also presented the provisions of the new anti-tax avoidance European Directive which refers to certain unprecedented concepts and terms in our domestic taxation.
In light of the changes brought by BEPS Action Plan and ATAD Directive it is recommendable that companies part of multinational groups already initiate discussions within their Groups in order to prepare for any upcoming challenges.
